I don't usually post a lot and find myself in a unique situation (for me anyways) and would benefit from your knowledge. Without going into any specifics as to the "why" since that should remain private, I am needing to withdraw my daughter from the cheer program that she is in. I asked the owner of the gym to please sign the waiver releasing my CP so that we could have everything done in order to find a program that better fits. I am not 100% certain yet where we will be going but would like to have everything at the old gym done and over with which is why I'd like the waiver signed. The gym owner stated that she would need to be the second person to sign the waiver and that the new gym would have to be the first person to sign it. Is that true? It doesn't really make sense to me as I would think you'd need to get released from somewhere before you could have another gym sign a waiver to accept you.

I just tried calling the USASF office but I got voice mails & am guessing that most people are out of the office enjoying the holidays. Any information that you could share would be greatly appreciated.

Not sure there is really an "order" but the intent for the waiver is to allow a release FROM a specific gym TO a specific gym.

You're basically requesting they release you without knowing what gym you would be attending. Not sure that was considered in designing the form.

Obviously, a USASF staff member is free to correct me on any of the above.

The waiver doesn't say who has to sign it first, just that both gyms need to sign it. The waiver is only necessary if your CP is planning on competing at Worlds with the new gym.

So basically, Cheer-ful Mom , though it sounds like you're just trying to get things in place, you jumped the gun. Unless your idea is that you don't want Gym A to know which gym Gym B is. Which shouldn't be unreasonable.

I'm not opposed to saying where I'm going - once I know where that is. I'd be happy to mail them back a copy of the completed agreement. I'm just trying to get things into place ahead of time since I'm not trusting of the situation. Again, it's a weird situation and I don't feel comfortable giving any unnecessary details. I just wanted to know if it was accurate or not that the primary gym owner had to sign second.

Thank you all for your help!! I truly appreciate it.

As ACEDAD said, I don't believe there's a specific order and as Andre said, unless CP is a L5 planning on World's, the form isn't required.
Honestly just sounds like the original gym wants to know where you're going before they agree to release CP. If that's the case, that's too bad.

But it's irrelevant if Gym B hasn't been decided. The whole point is being released to compete at Worlds, not just go to another gym. Cheer-ful Mom is working on the assumption that her cp WILL make a Worlds team, at a gym that WILL have a team that gets a bid and goes. It's all speculation and irrelevant until it happens.

After reading that waiver form, I wonder why the new gym even has to be on it. The issue to me is to be released from the old gym, not where your going to. And how is this enforced? Unless both owners are sitting in the same room signing the form with witnesses, anyone can turn around and challenge that its not valid. Does the USASF keep these on file or verify the release? Or would it become a he said/she said type of thing? Its just a piece of paper. You could get a waiver from your old gym, then have them turn around and say that it was a fake right before Worlds, how would you prove it one way or the other? I would hope everyone would be honest, but I've seen some crazy things go on in the cheer world.

I used to be all about this rule, but NOW I am just plain against it. The only reason owners should NOT sign the waiver is if the gym is owed money. In my opinion, if your balance is at zero, they should be released. Some people just aren't all about the kids at the end of the day.

My CP could be either Junior 5 or Senior 5. I can be fine with either. I just would like her to have the option if at all possible. Keep your fingers crossed for me. The owner gave me a date & time to pick up the signed waiver - now it's just a matter of seeing if she'll stick to her word or not. We have no past due bills or anything ever like that so there is no reason for the owner not to sign other than just not signing.

Try and get it notarized if at all possible with the old gym. That way there will be no question that she is released.

Good luck to you
