Can Not Get A Refund

If posted the story behind my daughter choosing to leave, that is one thing. Making it public that I asked several times for a refund and did not even get a response is another. This is info so another family is not in my situation.

No, this is info to try to publicly bully WC into giving you money. Don't pee on our legs and tell us it's raining.

I don't think putting it on Fierceboard is going to help you at all to get the money. As a a parent I understand your frustration, but this is not the way to do it.

Wow, this just screams of Cheer - Get This! | Fierce Board - The Voice Of Cheer and that thread did not end well. The fact you joined today and this was your very first post makes you lose credibility over your statement of "I am trying to do this nicely and not share my business" since it looks like that was your sole intention and just by mentioning it in a public forum is putting it out there.

You also make references of mistreatment and how not refunding this money is only hurting the child which further is trying to cast shadow and put your business out there. WC is a well respected FOR-PROFIT business in this industry (yes cheerleading is a FOR-PROFIT industry) and as such will do what is best for the business. Sorry to say but that is a harsh reality of this industry.

Sorry to say but no one here will be able to advance your cause but you can be rest assured Elaine has probably already heard of this post and has a good idea of who started it, which IMO will not help your case.

It states very clearly in the 2013-14 Tryout Packet found on their website that:

"Refunds will not be issued due to someone quitting or for removal from the team."

It is always good to read the fine.....or in this case BIG BOLD print....

I paid for two kids entire season (different gym) in full, up front last year (note to self, don't do that) and they were completely miserable by December.

We didn't quit because 1) they made a commitment they needed to honor and 2) I KNEW there was no way I'd ever see that money again if only because it was written in the parent pack.

We made a choice. So did you. You probably should've put more research on gym policy under your belt before you made that decision.

Lord. I knew better than to open this thread.

So I went to this link and read it for myself. It also says "Competition and Travel Fees include competition entry fees only." I had no idea what the OP meant by "travel fees" since I've never heard it called that. We just paid comp fees and paid for our own travel. Sounds like this is the same thing with a fancier name. So that means what you paid for is comp fees. It's AUGUST. Chances are that money has already been paid to the EP's. In order to get good early bird pricing most gyms pay those fees as early as possible. That's why most gyms have a no refund policy, because they get the money from us (parents) and immediately pay it out to whoever it's supposed to go to (well, reputable gyms do this. WC is reputable so I'll just assume they also do this). It's not like WC is just sitting there, hanging out with your money, waiting for you to decide if you want to stick around. Once you pay, it's gone.

As for you claiming you never signed anything...did your cp tryout? Because it says right in that packet that you must bring the signed registration form, code of conduct, and financial commitment form to tryouts. All 3 of these documents require signature. If your cp got as far as being placed on a team then I'm guessing you signed the forms that were required. The no refund statement is right there, in GIANT bold italic print.

As a parent, I totally understand why you are upset. And as a single parent I even more understand that $1400 is a LOT of money. I hate no refund policies, but they exist. Hating them doesn't make them unenforceable. And I don't know what attorney told you that something you signed was invalid, but last I checked that's not true.

I also think your attorney would do good to advise you to stay off social media with something you are planning on suing someone over.

One of my boys plays on an all-star team in the summer. You tryout in October and are placed on a team, you pay the $1500 (covers summer practices, uniforms, and tournaments). It's non-refundable, so if DS blows his ACL playing in the winter and still can't play when summer rolls around-I'm out the $1500.
