    Hi, everyone!

    I see a lot of comments on here about how difficult it is to access videos of some of our favorite teams and routines, so I thought some of you might be willing to weigh in. :) I am a former allstar and college cheerleader (from before allstar teams competed on spring floors...if that gives you any idea of just how "former"!) and I am looking to the cheer community for help!

    I am a law student working on a project that examines the merits of granting copyright protection to allstar cheer choreography. One of the reasons I am looking at this is because if you can get protection for the choreography as performance art, you can control the authorization of performing, RECORDING, and licensing of your routine...


    Cheerleading routines haven't been given copyright protection YET, but I think that could change because the performance value of the sport itself has changed. We have all been to competitions where run-throughs and practices are packed with spectators, right? I don't know about you, but I have been drawn in to watching these things because they're entertaining (not just because I'm curious to see what the competition is going to be putting on the mat).

    Please consider sharing your thoughts on whether cheer routines should be copyrighted. You can message me directly if you don't want to clog up this feed. I am new to FierceBoard and NOT trying to derail the discussion!

    Cheerleading is not performance art and there is nothing to copyright.


    From the copyright law regarding choreography/performance art (here):

    Page 64: Competitive activities are comprised of athletic maneuvers rather than dance steps, and such maneuvers are non-expressive. Competitive activities lack the capacity for uniform performance because each contest usually involves a different set of maneuvers, and any dramatic content involves the “drama” of the competition rather than a story that is told or a theme that is evoked by the players’ movements.

    Non-expressive physical movements, such as “ordinary motor activities” or “functional physical movements” — in and of themselves — do not represent the type of authorship that Congress intended to protect as choreography.

    On the topic of "should it be"? No, copyright stagnates growth and innovation. That's not something I want in competitive environments.

    I like the video angle where it shows her putting on the backpack after they hit.. Ha. So cute

    I know!! She was like, ok, we hit, now gotta clear out for the next coaches. Seems like she’s been at this coaching gig for a while now.... :)

    That was the best part for me as well! She's all business strapping on her little backpack after they hit.
