Serious question: is there a case to be made here for charging her with creating/distributing child porn? Or at least intent to do so? Because even though that’s not what she actually did, she clearly tried? I mean she took the face of a minor and tried to make them look nude. It just feels like a felony to me.

I, personally, think it should be a felony, but it appears it's a misdemeanor and she's being charged with three counts of cyber harassment and three counts harassment (which could equate to six months to a year in prison). What prevented it from being a felony is she used "skin tone bars" (many of the articles left this out) to make the girls appear nude. IMO, doctoring someone else's photos to make them "appear" nude with the intent of harming them should be a felony.
