Level 1 Cradle

Most scrunch/sponge tosses start with the flyer in a sponge position, ie flyer's knees bent and hands on bases. Cradles, on the other hand, are dismounts from stunts, so the flyer would transition directly from a stunt position (ie legs locked, hands not touching bases) through the toss to a cradle position. Just guessing that this would be the way that judges could differentiate between legal level 1 cradles and illegal tosses.

True, but unfortunately there is a lot of improper technique in some level 1s (definitely not all because there are tons of phenomenal level 1 squads!!!). If the flyer doesn't have proper technique, then they could very well have bent legs and hands on the bases, especially if they are 'anticipating' the cradle. I'm sure there is a way that it could be done legal and right, but of course technique would be a deciding factor.

Would they be in a thigh stand, or a sponge but the flyer is standing up?

Flyer is standing up. If she was in sponge then it absolutely would be a toss.

I've been meaning to film and post the video but haven't got round to it.

Basically, we were called on this at a competition, and the argument was that it was a toss. We argued that it's a cradle, not a toss. The wording in the glossary for both cradle and toss apply to the stunt, so we had the deduction reversed and they are going to look at the wording when the rules are next updated.

The rules have been updated for 2012-2013 already.

It looks like this is going to come down to a judgement call by the rules judges on whether the skills is a cradle from a stunt or a sponge toss. I'd only keep the skill in the routine if you're willing to take the risk of that judgement not going in your favor.
