So if the flyer could some how do it without her hands on his shoulders, and the base could make it so it wasn't a release move, that would make it legal?

The only way to make it legal with 2 people is for the base to remain connect with the flyer's leg or foot. The top girl can still have her hands on the shoulders but because the base is connected with the foot, the lowest point of connection is no longer at prep (shoulder) level.
